This Hosting Services Addendum (“Addendum”) supplements the Terms and Conditions of Alpha27, Inc. and applies to clients who purchase website hosting services.
1. Hosting Services Overview
Alpha27 provides website hosting services through third-party infrastructure providers, including but not limited to Cloudways and DigitalOcean, located in the United States.
Hosting services may include:
- Server space
- Basic server configuration
- SSL certificate installation
- Routine maintenance updates
- Limited technical support
Specific service levels are defined in individual service agreements.
2. No Guaranteed Uptime
While Alpha27 makes commercially reasonable efforts to maintain reliable hosting services, we do not guarantee uninterrupted or error-free service.
Alpha27 shall not be liable for:
- Server downtime
- Infrastructure outages
- Data center failures
- Distributed denial-of-service (DDoS) attacks
- Third-party hosting interruptions
- Force majeure events
Any uptime percentages discussed are goals, not guarantees.
3. Third-Party Infrastructure
Client acknowledges that hosting services rely on third-party providers.
Alpha27 is not responsible for:
- Provider outages
- Infrastructure changes
- Pricing changes imposed by providers
- Service-level failures beyond our direct control
Client agrees that any claims related to infrastructure must be limited as outlined in the main Terms & Conditions.
4. Data Ownership & Responsibility
Client retains ownership of all website data and content.
Client is solely responsible for:
- The legality of stored data
- Compliance with privacy laws
- Maintaining appropriate policies on their website
- Securing appropriate user consents
Alpha27 acts solely as a service provider and does not assume legal responsibility for client content.
5. Backups
Backups may be performed periodically; however:
- Backups are not guaranteed unless explicitly stated in writing.
- Alpha27 is not responsible for data loss resulting from corrupted files, malware, or user error.
- Client is encouraged to maintain independent backups of critical data.
6. Security
Alpha27 implements reasonable security measures including:
- SSL encryption
- Server-level protections
- Restricted administrative access
However, no hosting environment is immune from security incidents.
Alpha27 is not liable for:
- Unauthorized access caused by client credential sharing
- Malware introduced via client-installed plugins
- Vulnerabilities in third-party themes or plugins
- Breaches resulting from outdated client-approved software
7. Acceptable Use
Client agrees not to use hosting services for:
- Illegal activities
- Spam distribution
- Malware distribution
- Copyright infringement
- Fraudulent or deceptive practices
- Activities violating third-party platform policies
Alpha27 reserves the right to suspend hosting immediately if illegal or harmful activity is detected.
8. Payment & Suspension
Hosting fees are due according to the agreed billing schedule.
If payment is not received:
- Services may be suspended without notice
- Website access may be restricted
- Data may be archived or deleted after 30 days
Client remains responsible for all unpaid hosting fees.
9. Termination
Upon termination:
- Client may request a full website backup within 14 days.
- Alpha27 is not responsible for maintaining hosting beyond that period.
- Data not retrieved within 30 days may be permanently deleted.
Migration assistance may be available at an additional cost.
10. Limitation of Liability (Hosting Specific)
To the fullest extent permitted by law, Alpha27’s liability for hosting-related claims shall not exceed:
The total hosting fees paid in the three (3) months preceding the claim.
Alpha27 shall not be liable for:
- Lost revenue
- Lost business
- SEO ranking changes due to downtime
- Data corruption
- Cyberattacks
11. Indemnification (Hosting Specific)
Client agrees to indemnify and hold harmless Alpha27 from any claims arising from:
- Client website content
- Data privacy violations
- Intellectual property infringement
- Regulatory investigations
- Security incidents caused by client-installed software
12. Force Majeure
Alpha27 shall not be liable for delays or failures resulting from events beyond reasonable control, including but not limited to:
- Natural disasters
- Government actions
- Internet outages
- Infrastructure provider failures
- Cybersecurity attacks
13. Entire Hosting Agreement
This Addendum supplements and is incorporated into the main Terms and Conditions. In the event of a conflict, the Terms and Conditions control unless explicitly stated otherwise.
